Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. According to the standard view, Montaigne’s Pyrrhonian doubts would be in the origin of Descartes’ radical Sceptical challenges and his cogito argument. Although this paper does not deny this influence, its aim is to reconsider it from a different perspective, by acknowledging that it was not Montaigne’s Scepticism, but his Stoicism, which played the decisive role in the birth of the modern internalist conception of subjectivity. Cartesian need for certitude is to be better understood as an effect of the Stoic (...) model of wisdom, which urges the sage to build an inner space for self-sufficiency and absolute freedom. The aim of this paper is to discuss a basic assumption tacitly shared by many philosophers of mind and language: that whatever can be meant, can be said. It specifically targets John Searle's account of this idea, focusing on his Principle of Expressibility . In the first part of the paper, PE is exposed underlining its analyticity and its relevance for the philosophy of language , mind , society and action . In the critical part, the notion of Background is (...) taken into account in order to re-evaluate two basic distinctions: the one between sentence and utterance meanings , and the one between native and type speakers . PE is reconsidered in the light of the previous arguments as a methodological strategy that does not prevent uses of language from eventual semantic excesses and deficits , and a complementary Principle of Expression Fallibility is finally proposed. Knowledge, like other things of value, can be faked. According to Hawley (2011), know-how is harder to fake than knowledge-that, given that merely apparent propositional knowledge is in general more resilient to our attempts at successful detection than are corresponding attempts to fake know-how. While Hawley’s reasoning for a kind of detection resilience asymmetry between know-how and know-that looks initially plausible, it should ultimately be resisted. In showing why, we outline different ways in which know-how can be faked even when (...) a given performance is successful; and in doing so, we distinguish how know-how can be faked (no less than know-that) via upstream and downstream indicators of its presence, and within each of these categories, we’ll distinguish (in connection with detection resilience) both faking symptoms and (various kinds of) criteria. The unappreciated resilience of faked knowledge-how to successful detection highlights a largely overlooked dimension of social-epistemic risk – risk we face not just in our capacity as recipients of testimony, but in our capacity as both (would-be) apprentices and clients of knowledge-how. El propósito central del presente artículo, es formular un enfoque sistémico-jurídico para el análisis de los sistemas sociales. Para esto, se proponen tres tipologías de consensos denominados límites del sistema social: consenso normal, consenso normativo y consenso legítimo. La función de estas tipologías es, primero elaborar una explicación sobre la constitucionalización y democratización del poder político, con base en la regla de reconocimiento y la norma fundamental de un Estado; segundo postular dos metodologías normativas, un registro positivo y una demarcación (...) positiva, que desplieguen, tanto sobre las conductas sociales como sobre la estructura del sistema social, un proceso de legalidad emergente, cuya función sea, tercero regular, realimentar y optimizar el funcionamiento de la constitución política. Finalmente, se analizan los conceptos de completitud y de legitimidad del sistema normativo, con el fin de definir el alcance institucional que debe poseer un sistema jurídico sobre los subsistemas culturales del sistema social. ‘Reasoning’ can be considered a general concept that, upon speaking, is the ‘enraonar’, a Catalan word that should not be mistaken with ‘explain’ nor with ‘discuss’ which imply more detail, and cover different situations. This article is presented as an essay on the ancient ideal of ‘enraonar’. To that end, it is explained in what sense ‘enraonar’ and reason are one of the most complex phenomena thought has to deal with. Here it is argued that these natural phenomena require a (...) systematic and ‘scientific’ study, and that withoutthis knowledge computer science cannot simulate people’s every-day ‘enraonar’. Si concebimos el bienestar como condición para que se dé auténtica dignidad en la vida individual y/o colectiva, entre diferentes especies y generaciones de especies, lo cierto es que cabría colegir que la dignidad no tiene una única naturaleza ni, en relación a la que cupiera definir como la más conveniente o necesaria o justa, se instituye conforme a idénticos grados. La (esencia de la) dignidad sería, por consiguiente, relativa. Analicemos esto.

This article presents an explanatory hypothesis regarding an anomalous fact: the omission of complete information but also of the necessary interpretation about the identity traits and specific characteristics of civil society observed in many theoretical and practical contributions in studies on deliberative democracy. The difference between liberal democracy and the deliberative model is blurred when the task of interpreting deliberative practices is relegated or when the approach of critical theory is not applied in the analysis of the material political culture (...) of which deliberative agents are both the architects and the recipients. The hypothesis presented emphasizes the difficulties and systematic rejection generated by the main emancipatory achievements of modern citizens. The resistance aroused by these achievements among prestigious interlocutors of civil society has fueled a sophisticated reactionary rhetoric, which was reported by social science researcher Albert O. Hirschman. At the same time, the explanatory hypothesis used here has a key assumption: the existence of a striking correlation between certain argumentative imperatives and the meager cultural attention that the valuable pluralism observable in deliberative behavior receives today. In this article, the hypothesis according to which the institutional change is determined by the mobilization of social capital is exposed. It is analysed what consequences derived from this fact in relation to the processes of deinstitutionalization of the policy. It proposes an interpretation of academically relevant results about the meaning of the term ‘deinstitutionalization’, explains some of the most important antecedents on institutional theory and, fially, proposes some fundamental ideas to advance the philosophical reflction about the so-called new institutionalism.

One of the challenges related to the discursive practices of argumentative agents is to get to know if those interactions have an institutional effect. In this article, it is argued that in the new institutionalism, theoretical approaches and deterministic analysis are outlined to investigate argumentative practices that take place in processes of legitimation and recognition. Here a double socio-institutional and discursive or constructivist approach to the argumentation theory is defended, and it is argued that this perspective could be extended to (...) a research program aimed at interpreting argumentative processes in the public sphere that act as calculation mechanism and conformation of social capital. To help clarify the concept of «teaching practice», this article analyzes a repository of professional skills of the teacher. It then examines how two groups of teacher educators attempting to use this repository to evaluate two teaching sessions (one secondary and one primary). Analyses revealed the difficulty in assessing a session from elements determined a priori from a list of skills. The evaluation of a teaching session seems to require the inclusion of its organic whole. Afin de contribuer à préciser (...) la notion de « pratique enseignante », le présent article analyse un référentiel de compétences professionnelles de l’enseignant. Il examine ensuite la manière dont deux groupes de formateurs d’enseignants tentent d’utiliser ce référentiel pour évaluer deux séances d’enseignement (une dans le secondaire et une dans le primaire). Les analyses révèlent la difficulté à évaluer une séance à partir d’éléments déterminés a priori dans une liste de compétences. L’évaluation d’une séance d’enseignement semble requérir la prise en compte de sa totalité organique. (shrink)

This study applies Arne Naess’ ecosophy as a tool for possible progressive research material concerning the National Greening Program (NGP) of the Department of Environment and Natural Resources (DENR). This study aims to conduct a phenomenological analysis of tree farming advantages, driven by a philosophical approach and practical strategy integrated through the principle of deep ecology. The philosophy of deep ecology presupposes ethics and the interrelatedness of human beings to nature that generally can be experienced anywhere. This study aims to (...) assess the core motives, plans, objectives, strategic implications, initiatives, provisions, and the probable outcome of the said government program. To realize this, this research enunciates a possible parallel study between Naess's deep ecology and the DENR's goal. Since this study is concerned with the current situation of human beings, it delves into the context of the phenomenological research approach. It provides different perspectives on the other government officials who were once the program's authors and implementers. As this research goes on, the findings have various outlooks on applying deep ecology to facilitate the government's NGP. The crucial part of making this program absolute must be the participation of every individual in such advocacy as a sole environmental bailiff. However, the challenge never ceases to interrupt the goodwill of human beings. On the other hand, man's passion never fails to contribute to sustainable ecological preservation, biodiversity, reparation, and community commitment. (shrink)

La biología utiliza múltiples criterios para individuar fenómenos biológicos. Frente a esta diversidad, los enfoques monistas proponen criterios fundamentales para el reconocimiento unívoco de individuos, esto es, formas únicas de dividir el mundo biológico en entidades individuales. El pluralismo, por otro lado, argumenta que no deberíamos restringir el estudio de la individualidad a concepciones únicas, reconociendo, en su lugar, diferentes tipos de individuos. En este artículo, analizaré cómo ciertos enfoques monistas y pluralistas enfrentan la pluralidad de criterios de individuación utilizados (...) por la práctica científica. Siguiendo las recientes aproximaciones epistemológicas y pragmáticas en filosofía de la individualidad biológica, argumentaré por qué la diversidad de individuaciones no suele representar un inconveniente para la biología y por qué contribuye a nuestro conocimiento del mundo biológico. La conclusión general será que requerimos múltiples maneras de individuar la naturaleza para poder cumplir los diversos objetivos epistémicos de la biología, una labor que las aproximaciones monistas no suelen visibilizar. The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. En estas páginas hemos presentado varios argumentos para defender que existe una conexión entre el empleo de heurísticas y los procesos de deliberación. En lugar de caracterizar las heurísticas en función de las disciplinas, los campos y/o los ámbitos en que se emplean—tal y como hace, por ejemplo, el grupo ABC, i.e. racionalidad ecológica—las hemos proyectado sobre nuestros enclaves deliberativos, esto es, sobre un espacio eminentemente retórico y político. En dichos enclaves, tal y como solía recordarnos Quintín Racionero, la téchne (...) de la persuasión se nos presenta como parte del órganon de la filosofía práctica porque está aplicada a un espacio ontológico fundado por la comunicación humana. Y es en el seno de dicha comunicación como cabe entender la proliferación de razonamientos heurísticos encaminados al cálculo, la estimación y/o la ponderación, con ayuda de los cuales no sólo se orienta la acción colectiva sino las mismas fases de la deliberación. Desde la conquista española ha existido una dicotomía constante en la identidad peruana, la cual se refleja en el arte y especialmente en la literatura. Es en ella en la que existe un personaje que representa en sus obras de manera magistral los encuentros y desencuentros generados por la interacción constante de esos dos hemisferios culturales presentes en la peruanidad. Es José María Arguedas, quien no solamente retrata dicha realidad, sino que a través del indigenismo logra representar y revalorizar la (...) figura del indio y por consiguiente de lo andino, todo en el marco de la problemática constante que aqueja la búsqueda de lo que consiste ser peruano. El estudio y análisis de las argumentaciones cotidianas entendidas como interacciones discursivas e intencionales encaminadas a dar cuenta de algo con el fin de lograr que aquello que se sostiene sea aceptado, sería inconcebible sin la aparición de la teoría de los actos de habla de Austin (1962), la propuesta de Searle (1969), el trabajo de Grice sobre la teoría de la conversación (1975) y el importante estudio sistemático de Hamblin sobre el argumento falaz (1970). Como una reelaboración de dichas (...) obras cabe entender la teoría pragmadialéctica de la argumentación propuesta inicialmente por Frans H. van Eemeren y Rob Grootendorst (1984). Algunos autores (Blair, 2006: 11; Woods, 1992) creen ver en ella, más que una teoría, una amalgama de varias teorías y una particular versión de la teoría pragmadialéctica de la argumentación, entendiendo ésta bajo una acepción más general. Otros consideran que ni es útil ni tampoco especulativamente productivo sostener que de toda argumentación pueda buscarse un modelo según el cual ésta buscaría resolver una diferencia de opinión (Goodwin, 1999). Frans H. van Eemeren y Peter Houtlosser reaccionaron contra una separación estricta entre dialéctica y retórica en varios trabajos, pero uno de los más inspiradores es sin duda su artículo “William the Silent’s argumentative discourse” (1998) presentado en la ciudad de Ámsterdam con ocasión de la cuarta conferencia organizada (...) por la International Society for the Study of Argumentation (ISSA). This paper investigates the differences between ancient Greek and modern ethical naturalism, through the account of the whole classical tradition provided by Cicero in De finibus bonorum et malorum. Ever since Hume’s remarks on the topic, it is usually held that derivations of normative claims from factual claims require some kind of proper justification. It ́s a the presence of such justifications in the Epicurean, Stoic, and Academic-Peripatetic ethical theories (as portrayed in De finibus), and, after a negative conclusion, I (...) argue that we should conceive of this issue within a social-historical perspective: The radical difference between ancient and modern naturalistic ethics is due (in Weber’s terms) to the rationalization processes that generated the modern outlook on nature. If the cultural variations concerning knowledge and research on ordinary reasoning are part of cultural history, what kind of historiographical method is needed in order to present the history of its evolution? This paper proposes to introduce the study of theories of reasoning into a historiographic perspective because we assume that the answer to the previous question does not only depend of internal controversies about how reasoning performance is explained by current theories of reasoning. In spite of being ubiquitous in life sciences, the concept of information is harshly criticized. Uses of the concept other than those derived from Shannon's theory are denounced as pernicious metaphors. We perform a computational experiment to explore whether Shannon's information is adequate to describe the uses of said concept in commonplace scientific practice. Our results show that semantic sequences do not have unique complexity values different from the value of meaningless sequences. This result suggests that quantitative theoretical frameworks do (...) not account fully for the complex phenomenon that the term “information” refers to. We propose a restructuring of the concept into two related, but independent notions, and conclude that a complete theory of biological information must account completely not only for both notions, but also for the relationship between them. Concepts as reasonable doubt, cognitive biases and emotions are now a theoretical problem for the practice of law, and the law understood as legal argumentation. From a theoretical point of view, the screenplay written by Reginald Rose, Twelve Angry Men, is an outstanding example to analyze some of these concepts, and its influence on procedural stage. Cognitive biases and informal fallacies are theoretical challenge to legal argumentation.

Der Begriff der Toleranz in der Moderne wurde erdacht mit dem Ziel, Gesellschaften zu organisieren, die sich im Umbruch befanden auf Grund des plötzlichen Eindringens von Glaubensunterschieden in die politische Raumordnung. Die Definition der Toleranz als Tugend, die auf der Nachgiebigkeit gegenüber dem Andersartigen basiert, ist ein Pseudobegriff. Die hermeneutische Veranlagung, die mit der Philosophie einhergeht, zeigt, dass die Toleranz keine schlichte moralische Tugend sein kann, sondern vielmehr eine der Beschaffenheiten der Möglichkeit rationaler Handlungen (die Arten des Seins und des (...) Sagens fallen in der Vielfältigkeit ihrer Formen zusammen). Die Geschichte der Hermeneutik zeigt seit ihren Anfängen – die exegetische Arbeit war hierbei grundlegend – die Zwickmühlen der Existenzformen der Rationalität und lässt nur ein Denken an der Grenze zu, welche ihre Grundlage ist: Es gibt keine Tatsachen, sondern Interpretationen. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. En este artículo se analiza el planteamiento de Reinhart Koselleck en torno a la Begriffsgeschichte desde el punto de vista de la productividad de la historia, el tiempo y la productividad propia de la dialéctica de los conceptos. Para ello se traen a colación aspectos muy precisos de la filosofía de Aristóteles, Hegel y Gadamer. La reflexión concluye extrayendo algunas aportaciones que podrían enriquecer la investigación de Koselleck.
